Failing earned an bachelor's degree in music education from the University of Oklahoma in 2008. He received a J.D. from Oklahoma City University in 2012.

Failing has worked as a music educator and band director and as an attorney. He is a member of the Oklahoma Bar Association, Kappa Kappa Psi, and the Oklahoma State Board of Education. [1]

Failing made the following statement to Ballotpedia regarding his political philosophy:[1]

People first... too often politicians put political affiliation ahead of doing the right thing. We have to do what is right by the citizens of our state, and that starts by listening to them. My goal is to be a statesman not a politician, to be a representative of the people not lobbyists, and to bring back common sense values to our state.

I'm a country guy from Noble, I have a solid educational background grounded in strong Oklahoma country roots, and that makes me perfect for the job of representing the good people of this state. My door is open to anybody and I firmly believe the voice of every Oklahoman should be heard in their state's government. [2]
