An effort in Yankton, South Dakota, to recall Mayor Curt Bernard and City Commissioner Dan Rupiper was initiated in October 2007. Petitioners submitted enough signatures to put the recall on the ballot. The election took place on December 18, 2007, and both officials were removed from their positions as a result of the recall. David Carda and David Knoff earned the most votes in the recall election.[1]
Recall supporters
The recall effort was initiated in response to the resignation of City Manager Jeff Weldon on October 12, 2007. Petition language stated that Bernard and Rupiper forced Weldon to resign.[1]
Recall opponents
Bernard and Rupiper filed a writ of prohibition with the 1st Judicial Circuit Court, arguing that there were not sufficient grounds for a recall.[2] On December 6, 2007, Judge Bruce Anderson ruled that petition language did meet the requirements for allowable grounds.[1]

According to §9-13-30, the allowable grounds for removal are misconduct, malfeasance, nonfeasance, crimes in office, drunkenness, gross incompetency, corruption, theft, oppression, or gross partiality.
Recall organizers were required to submit valid signatures equal to 15% of the registered voters of the municipality, based upon the total number of registered voters at the last preceding general election. Signatures needed to be gathered within a 60-day window.
