Ballot question

The ballot question was as follows:[1]

To fund general municipal expenses such as police, fire, roads, and recreation, shall the City tax cannabis (marijuana) businesses at an annual rate not to exceed 10% of gross receipts for all commercial cannabis activities conducted in the City which is expected to generate an estimated $1.2 million to $1.6 million annually and will be levied until repealed by the voters or the City Council? [2]

Impartial analysis

The following impartial analysis of the measure was prepared by the office of the Maywood City Attorney:

Measure CT, if passed by the voters of the City of Maywood (“City”) would impose a general tax on commercial cannabis activity (marijuana) businesses in the City. A maximum tax rate of ten cents ($.10) for each one dollar ($1.00) of gross monthly business proceeds of commercial cannabis activity is imposed. This tax is not a sales tax. This tax is imposed on commercial cannabis activity that include retail or wholesale distribution, cultivation, manufacture, transportation (including delivery), or testing of commercial cannabis.

These taxes are estimated to annually collect $1.2 million to $1.6 million in potential revenue for the City. The revenue generated from these taxes will be deposited into the City’s general fund; typical expenditures include expenses such as police, fire, roads, and recreation.

Regulations are established for the administration of the tax collection, including enforcement, penalties, and refunds. The City may promulgate further regulations to implement and administer Measure CT to ensure the efficient and timely collection of the taxes imposed. There is no sunset clause on the proposed taxes. All of the regulations established by Measure CT may be amended or repealed by future action of the City Council, except for the maximum tax rates may only be increased with voter approval.

A “Yes” vote means you support taxing commercial cannabis activity (marijuana) in the City.

A “No” vote means you oppose taxing commercial cannabis activity (marijuana) in the City.

This measure will take effect only if a majority of those voting on this ballot measure cast a “Yes” vote at the General Municipal Election of November 6, 2018.[2]
