Katz and public defender Tiffany Caban were the top two finishers in the June 25, 2019, Democratic primary for Queens District Attorney. While Caban appeared to be the first-place finisher on election night, Katz appeared to be the first-place finisher after mail-in ballots were counted. A manual recount which concluded July 25, 2019, found Katz in the lead. The Caban campaign filed a lawsuit challenging the disqualification of certain affidavit ballots. The New York Supreme Court heard arguments on August 6, 2019. Following the hearing, Caban decided not to pursue further legal action and formally conceded the race to Katz.[2][3]
