Noteworthy cases
Cases regarding President Obama’s citizenship
On February 3, 2012, Judge Malihi dismissed a challenge to President Barack Obama's appearance on Georgia's Democratic primary ballot based on claims that Obama did not meet the Constitution's citizenship requirements. Malihi ruled that the evidence to support such claims was insufficient and unpersuasive. Malihi also ruled that challenges to the citizenship of Obama's parents were irrelevant since Obama was a U.S. citizen at birth due to his being born in the United States. In January 2012, Malihi had denied the Obama administration's motion to have a challenge to Obama's ballot eligibility dismissed without a hearing.[3]
