To put a legislatively referred constitutional amendment before voters, a two-thirds (66.67%) vote is required in both the Montana State Senate and the Montana House of Representatives.

The amendment was introduced on March 23, 2023, as SB 534. On April 4, 2023, the Montana State Senate passed the amendment by 31-19. The measure was not passed in the House before the state legislature adjourned its 2023 session.[1]
