To put a legislatively referred constitutional amendment before voters, a two-thirds (66.67%) vote is required in both the Montana State Senate and the Montana House of Representatives.

The amendment was introduced on February 3, 2023, as Senate Bill 272. On April 4, 2023, the Montana State Senate voted 22-28 on the bill, referring to the state House. To qualify for the ballot, 100 of the 150 state legislators (100 Representatives and 50 Senators) must vote in favor of the amendment. Since the bill received 22 votes in the Senate, 78 votes are required in the House. The measure did not receive the required 100 votes to be placed on the ballot.[1]
