NM Supreme Court to rule on public records case

Santa Fe, New Mexico: The New Mexico Supreme Court is preparing to hear arguments in a New Mexico Inspection of Public Records Act case which will have a great impact on the ability of citizens in New Mexico to monitor the performance of public employees. The case, Cox v. New Mexico Department of Public Safety, revolves around a citizen's attempt to view copies of complaints filed by citizens concerning the behavior of Department of Public Safety (DPS) employees. DPS rejected the original request made under the New Mexico Inspection of Public Records Act alleging that the release of the records would constitute an unwarranted invasion of personal privacy. The New Mexico Court of Appeals ruled against DPS claiming that the records were public. A decision is expected in the next 6 months.[1]
