Ballot title

The ballot title for Amendment 4 was as follows:

"For amendments to establish a State Department of Education; to provide for a State Board of Education and the election and term of office of the members thereof; to provide for a Commissioner of Education, and the appointment thereof, and how his salary shall be fixed; to provide that all provisions in the Constitution of Nebraska and the laws of the state relating to Superintendent of Public Instruction shall insofar as applicable apply to and mean the State Department of Education, State Board of Education, or the Commissioner of Education, as the case may be; and to amend Article IV, section 1, Article VII, sections 1 and 13, and Article XVII, section 3, of the Constitution of Nebraska."

A 60% supermajority vote is required during one legislative session for the Nebraska State Legislature to place a constitutional amendment on the ballot. That amounts to a minimum of 30 votes in the unicameral legislature, assuming no vacancies. Amendments do not require the governor's signature to be referred to the ballot. A simple majority vote is required for voter approval. However, the number of affirmative votes cast for the measure must be greater than 35% of the total votes cast in the election. This also applies to citizen initiatives.
