Nebraska Initiative Measure 404 was on the ballot as an initiated constitutional amendment in Nebraska on November 6, 1990. It was defeated.

A "yes" vote supported amending the state constitution to establish a state lottery system that authorized certain nonprofits to conduct electronic or video lotteries supervised by the Veterans Lottery Control Council.

A "no" vote opposed amending the state constitution to establish a state lottery system that authorized certain nonprofits to conduct electronic or video lotteries supervised by the Veterans Lottery Control Council.

The ballot title for Initiative Measure 404 was as follows:

Shall the Nebraska constitution be amended to provide for a Nebraska State Lottery System where, through 1995, certain non profit organizations could conduct mechanical, electronic or video lotteries under supervision of a Veterans Lottery Control Council appointed by the Governor with approval by the Legislature, and where the state would receive fees for the use of lottery equipment by vendors to be deposited in a Nebraska State Lottery System Fund, and allocated no more than ten per cent to pay administrative expenses, twenty five percent to the Nebraska State Veterans Aid Fund, and the remainder to property tax relief?

A vote FOR will amend the Nebraska Constitution so as to create a Nebraska State Lottery System where, through 1995, certain nonprofit organizations may conduct mechanical, electronic or video lotteries under supervision of a Veterans Lottery Control Council appointed by the Governor with approval by the Legislature, and where the state would receive fees for the use of lottery equipment by vendors to be deposited in a Nebraska State Lottery System Fund, and allocated no more than ten per cent to pay administrative expenses, twenty five per cent to the Nebraska State Veterans Aid Fund, and the remainder to property tax relief. No other tax could be imposed upon lottery equipment other than the fee for use.

A vote AGAINST will not cause the Constitution of Nebraska to be amended to create the Nebraska State Lottery System.

An initiated constitutional amendment is a citizen-initiated ballot measure that amends a state's constitution. Eighteen (18) states allow citizens to initiate constitutional amendments.

In Nebraska, the number of signatures required for an initiated constitutional amendment is equal to 10% of registered voters at the signature deadline. Nebraska also has a distribution requirement that requires initiative proponents to collect signatures from 5% of the registered voters in two-fifths (38) of Nebraska's 93 counties. A simple majority vote is required for voter approval. However, the number of affirmative votes cast for the measure must be greater than 35% of the total votes cast in the election. This also applies to legislative referrals.
