The New Jersey Suspension and Replacement of Indicted Elected Officials Amendment was not on the November 3, 2015 ballot in New Jersey as a legislatively referred constitutional amendment. The measure would have suspended elected officials who have been indicted and provide for temporary replacements. It would have provided for the return of the elected official upon acquittal or the declaration of a vacancy, if the official were convicted. At least three versions of such an amendment were proposed in the 2014-2015 legislative session including Assembly Concurrent Resolutions 23 and 27, as well as Senate Concurrent Resolution 78.[1][2][3]

Path to the ballot

At present, proposed constitutional amendments have two ways of achieving ballot access. The New Jersey Legislature can either qualify an amendment with supermajority approval of 60 percent in one legislative session or with simple majorities in two successive sessions. This measure did not receive the necessary supermajority required for a 2014 ballot placement. The measure did not come up for a vote in 2015.
