The New Mexico Referendum: Levying of Taxes, also known as Amendment No. 2, was on the ballot in New Mexico on November 5, 1974, as a legislatively referred constitutional amendment. It was approved. The referendum would have barred the levying of taxes by parts of the government that do not have legislation stating that they may.[1]

The question on the ballot:

CONSTITUTIONAL AMENDMENT No. 2: Proposing an amendment to Article 8 of the Constitution of New Mexico barring the levying of any tax or assessment by any political subdivision whose enabling legislation does not provide for an elected governing authority.[2]
