The New York Appeals to Court of Appeals, Amendment 5, also known as Proposed Amendment No. 5, was on the ballot in New York on November 6, 1951, as a legislatively referred constitutional amendment. It was approved. This amendment provided for "appeals to court of appeals, by permission, from non-final orders in proceedings by or against public officers."[1]
