The New York Judiciary Article, Amendment 5, also known as Proposed Amendment No. 5, was on the ballot in New York on November 8, 1938, as a legislatively referred constitutional amendment. It was defeated. This amendment was submitted by the constitutional convention. It would have amended a judiciary article.[1]
