New York state legislative special elections, 2012
Five special elections for the New York State Legislature took place in 2012. These elections were called to fill vacancies in the New York State Assembly, Districts 93, 100, 103, & 145, and the New York State Senate, District 27.
How vacancies are filled
If there is a vacancy in the New York Legislature, a special election must be held to fill the vacant seat. A special election can be held as long as the vacancy occurred before April 1 of the last year of the former officeholder's term. If a special session is called in the state legislature after this date, a special election may be called to fill the seat.[1] The person elected to fill the vacant seat serves for the remainder of the unexpired term.[2]

Marcus Molinaro (R) resigned after being elected Dutchess County executive.[9][10]
Note: On March 30, Richard Wager conceded defeat to Didi Barrett (D). Barrett led Wager by 137 votes. Approximately 1000 absentee ballots remained to be counted.[11][12][13] | |

Mark Schroeder (D) resigned after being elected Buffalo City comptroller.[14][15]

Carl Kruger (D) resigned in 2011 after pleading guilty to corruption charges.[17][18]
Note: After a contested result, legal wrangling, and a hand recount, Lewis Fidler (D) conceded the election to David Storobin (R) on May 31. The hand recount revealed that Storobin had won by approximately 15 votes. During the legal process, each side accused the other of vote fraud, and a significant number of absentee ballots were disputed. On May 14, the Board of Elections decided to recount the votes by hand.[19][20][21][22][23][24][25][26] | |
