New York state legislative special elections, 2016
Four seats were vacated in the New York State Legislature in 2016. All four seats were filled through special elections.
Vacancies filled
- State Assembly District 59: The seat was vacant following Roxanne Persaud's (D) election to the state Senate in November 2015.
- State Assembly District 62: The seat was vacant following Joseph Borelli's (R) election to the Staten Island City Council in November 2015.
- State Assembly District 65: The seat was vacant following Sheldon Silver's (D) conviction on November 30, 2015. He was removed from office after he was found guilty of all seven charges.
- State Senate District 9: The seat was vacant following Dean Skelos' (R) conviction on December 11, 2015. He was removed from office after he was convicted of eight counts of corruption.
Breakdown of 2016 special elections
Across the country in 2016, special elections for state legislative positions were held for a variety of reasons:
- 23 were due to appointment, election, or the seeking of election to another position
- 11 were due to a retirement
- 11 were due to the incumbent accepting another job
- 12 were due to a death
- 4 were due to a conviction
- 3 were due to filling a remaining term
- 1 was due to an expulsion
The partisan breakdown for vacancies were as follows:
- 37 Democratic seats
- 28 Republican seats

How vacancies are filled
If there is a vacancy in the New York Legislature, a special election must be held to fill the vacant seat. A special election can be held as long as the vacancy occurred before April 1 of the last year of the former officeholder's term. If a special session is called in the state legislature after this date, a special election may be called to fill the seat.[1] The person elected to fill the vacant seat serves for the remainder of the unexpired term.[2]

A special election for the position of New York State Assembly District 59 was called for April 19. Candidates were nominated by parties rather than chosen in primaries.[3] The seat was vacant following Roxanne Persaud's (D) election to the state Senate in November 2015.[4] Jaime Williams (D) defeated Jeffrey J. Ferretti (R) in the special election.[5][6][7]

A special election for the position of New York State Assembly District 62 was called for April 19. Candidates were nominated by parties rather than chosen in primaries.[8] The seat was vacant following Joseph Borelli's (R) election to the Staten Island City Council in November 2015.[9] Ronald Castorina Jr. ran on the Republican, Conservative, Independent and Reform Party tickets in the special election. Castorina was unopposed in the special election.[10][11]

A special election for the position of New York State Assembly District 65 was called for April 19. Candidates were nominated by parties rather than chosen in primaries.[12] The seat was vacant following Sheldon Silver's (D) conviction on November 30, 2015. He was removed from office after he was found guilty of all seven charges.[13] Alice Cancel (D) defeated Lester Chang (R), Yuh-Line Niou (WF) and Dennis Levy (G) in the special election.[14][15]

A special election for the position of New York State Senate District 9 was called for April 19. Candidates were nominated by parties rather than chosen in primaries.[16] The seat was vacant following Dean Skelos' (R) conviction on December 11, 2015. He was removed from office after he was convicted of eight counts of corruption.[17] Todd Kaminsky (D) defeated Christopher McGrath (R) and Laurence Hirsh (G) in the special election.[18][19][20]
