New judge ordered for murder trial

Montana: The Montana Supreme Court has ordered that a new judge be appointed to preside over the hearing of Barry Beach's petition for post conviction relief. Beach was convicted of murder in 1984 is seeking a new trial based on the testimonies of others in 2007 that could have possibly connected others to the crime he was convicted of. In 2008 Judge David Cybulski, of theMontana 15th Judicial District Court, refused to hear Beach's request based on the 2007 testimonies before the Board of Pardons and Parole. The state Supreme Court ordered a hearing after Cybulski did not give an analysis of the information on which he based his decision. The Supreme Court asked that he recuse himself, but after his refusal to do so, has ordered that he be removed from the case and appoint another judge.[1]
