The Nez Perce Tribal Court is a tribal court in Idaho. It is the court of the Nez Perce Tribe in Lapwai, Idaho.[1]

Jurisdiction

The Nez Perce Tribal Court has original jurisdiction over the following:[2]

  • (a) crimes committed by any Indian within the Nez Perce Reservation;
  • (b) violations of the Nez Perce Tribe Fish and Game laws committed by a member of the Nez Perce Tribe outside the Nez Perce Reservation at any usual and accustomed fishing place or upon open and unclaimed lands; and
  • (c) any and all violations of the Nez Perce Tribal Code committed by a member of the Nez Perce Tribe outside the Nez Perce Reservation at any in-lieu site or any treaty fishing access site (tfas); and (added by NPTEC 5/25/10)
  • (d) civil actions at law or in equity, involving any person or entity and arising under the Constitution, By-laws, laws and regulations of the Nez Perce Tribe, or to which an Indian or Indian owned property is a party.[3]

About tribal courts

There were approximately 400 tribal courts in the United States as of 2021, according to the U.S. Department of the Interior.[4] These courts can hear both criminal and civil cases regarding tribal code. Tribes that do not establish their own court may use a regional Court of Indian Offenses. These are also known as CFR Courts, since they were established by the Code of Federal Regulations.[5]
