North Dakota District Court Judge sentences Kirkpatrick to life in prison

North Dakota: North Dakota East Central Judicial District Judge Steven L. Marquart has sentenced Gene Kirkpatrick to life in prison without parole for his role in the murder of Phillip Gattuso. Marquart heard appeal in the form of letters and testimony from Kirkpatrick's family exonerating his character. Roy Gattuso, Phillip's brother, was the only witness called by the state. Marquart told the defendent during his sentencing that, "This was not a crime of passion, it was a calculated plan."[1]
