The North Dakota Tobacco Settlement Constitutional Amendment did not appear on the 2010 ballot in North Dakota.[1] Proposed by Sen. John Andrist, the measure proposed overturning some provisions of the North Dakota Tobacco Use Prevention and Control Program Initiative.
The measure concerned how the state should use the money it received from tobacco lawsuits. The 2008 initiative earmarked the tobacco settlement funds for particular purposes, such as prevention.
According to measure sponsor John Andrist, the 2008 initiative may have been unconstitutional and thus, subject to lawsuits. He thought the state's voters should re-consider it.[2]
