One seat was vacated in the North Dakota State Legislature in 2016. The seat in state House District 15 was filled through a special election.

How vacancies are filled
If there is a vacancy in the North Dakota State Legislature, the vacancy is filled by the district committee of the political party that holds the seat. A replacement must be named within 21 days of the vacancy. The appointed person shall serve until the next general election which is scheduled for at least 94 days after the vacancy occurs. Qualified electors in a district where a vacancy exists can also petition for a special election to be called by the governor to fill the remaining term.[1]

A special election for the position of North Dakota House of Representatives District 15 was called for November 8. Candidates were nominated by their parties rather than through primaries. The winner filled Hofstad's remaining term. The seat was vacant following Curt Hofstad's (R) death on June 18, 2016. He died of an apparent heart attack.[2] Incumbent Greg Westlind defeated Brenda Bergsrud in the North Dakota House of Representatives District 15 special election.[3][4]
