Oklahoma State Question 398 was on the ballot as an initiated state statute in Oklahoma on September 20, 1960. It was defeated.

A "yes" vote supported allowing each county to decide whether to transfer the construction and maintenance of county roads to the State Highway Commission or to continue under county commissioners.

A "no" vote opposed allowing each county to decide whether to transfer the construction and maintenance of county roads to the State Highway Commission or to continue under county commissioners.

Ballot title

The ballot title for State Question 398 was as follows:

Shall an Act providing each county determine whether it shall transfer the construction and maintenance of county roads to State Highway Commission or continue by county commissioners; subsequent elections upon petition; definitions; procedure for continual improvement and new construction, annual plans, controls by county commissioners, resident road supervisor, local purchases, transfer of property with additional roads therefor and other provisions in adopting counties; amending or repealing sections apportioning certain taxes to cause distribution in conformity with people's will in each county; other provisions, and declaring provisions severable, be approved and adopted?

In Oklahoma, the number of signatures required for an initiated state statute was equal to 8% of the votes cast in the last general election. In 2010, voters approved State Question 750, which changed the signature requirement to be based on the preceding gubernatorial election. A simple majority vote is required for voter approval.
