Paul R. Cherry was a federal magistrate judge for the United States District Court for the Northern District of Indiana. He was appointed to this position on October 1, 2003.[1] Cherry retired December 31, 2018.[2]

After his retirement, Cherry became a part-time magistrate judge on the same court.[3]


Education

Cherry received a B.A. from Huntington University in 1973 and graduated with honors. He went on to receive a J.D. in 1978 from Ohio Northern University School of Law. Cherry also graduated from the Indiana Judicial College in 1984.[1][4]

Career

Judge Cherry began his career in 1978 as a private practice lawyer. He worked in this capacity through 1988. During this time, he also worked as a deputy prosecuting attorney (1980 to 1982) and a prosecuting attorney (1983 to 1988) in DeKalb County. In 1989, he became a DeKalb County Circuit Court judge. He worked in this capacity until he was appointed magistrate judge in 2003.[1]

Throughout his career, he also taught as an adjunct faculty member at Huntington University, Valparaiso University Law School, and Calumet College of St. Joseph.[1]

Judge Cherry presided in the first court appearance of Dr. Mark Weinberger, known as the "fugitive nose doctor" on March 1, 2010. Dr. Weinberger is charged with 22 counts of healthcare fraud including billing over $300,000 in health insurance claims for procedures that were never performed. An arraignment for Dr. Weinberger was scheduled for March 4, 2010.[5]

Larry Mayes v. City of Hammond, Indiana, et al. (2006)

Cherry presided over the jury trial in Larry Mayes v. City of Hammond, Indiana, et al. In 1981, Mayes had been convicted of rape, unlawful deviate conduct, and robbery and was subsequently sentenced to 110 years in prison. Mayes was ultimately exonerated via DNA testing and was released from prison after having served approximately 21 years of his sentence. He sued the City of Hammond, its police department, and seven police officers, alleging violations of his civil rights for wrongful arrest, conviction, and imprisonment. The jury found in favor of Mayes and awarded him $9 million in damages.[6]
