Petition signed to remove superior court judge from ballot

Indiana: Twelve citizens of Allen County, Indiana, have singed a petition challenging the Indiana Election Commission's inclusion of Judge Kenneth Scheibenberger on this year's ballot. The group says that they believe he cannot run because of a judicial discipline he received from the Indiana Supreme Court in January of 2010. However, many lawyers have said that this disciplinary action does not prevent Scheibenberger from being a judge because only lawyers, not judges, are disqualified from running for judgeship if they are disciplined by the Indiana Supreme Court Disciplinary Commission. Dan Sigler, a former county prosecutor formerly involved in handling elections laws, said this, "They are confusing the (Supreme Court’s) Disciplinary Commission with the Judicial Qualification Commission."[1]
