Text of measure

Ballot question

The ballot question was as follows:[1]

To prevent elimination of the City's Police Department/maintain long-term financial viability/essential services including quick 911 response; gang, drug, crime prevention and investigations; street, storm drain, pothole and gutter repair; keep public areas clean and graffiti-free; and provide other general City services, shall the ordinance establishing a one-cent sales tax until ended by voters be adopted to provide $1,800,000 annually, requiring citizen oversight and independent audits, with all funds controlled locally?[2]

Impartial analysis

The following impartial analysis of the measure was prepared by the office of the Port Hueneme City Attorney:

California Elections Code section 9280 requires the City Attorney to prepare an analysis Of any proposed City ballot measure, which includes the effect of the measure on existing law and the operation of the measure. Measure U was placed on the ballot by the City Council in accordance with Resolutions Nos. 4210 and 4228.

EXISTING LAW

Currently, the sales tax rate in the City of Port Hueneme ("City") is 7.75 percent. Of the 7.75 percent, the City currently receives 1.5 percent for the local General Fund budget. The City is currently providing many of its services without adequate funding, resulting in a deficit of approximately $1.000,000 per year despite reducing City services, postponing street and road maintenance, and reducing the number of City employees nearly 20 percent.

PROPOSED MEASURE

Measure U proposes an ordinance that would establish a one-cent transactions and use tax for sales of tangible personal property through retailers within the City's jurisdiction. Measure U is a "transactions and use tax" as opposed to a "sales tax." A transactions and use tax is collected in the same manner as a traditional sales tax with minor exceptions. Taxes collected pursuant to Measure U would not be sent to the State or County, but would be deposited into the City's General Fund, which would allow these revenues to fund local essential services, including providing quick responses to 9-1-1 emergencies, preventing gang activity and drug-related crimes, maintaining streets and repairing potholes, providing crime prevention and investigation, repairing and maintaining buildings, sidewalks, curbs, and gutters, and keeping public areas clean and free of graffiti. The City estimates that this Measure would result in General Fund revenue of approximately $1.8 million annually.

ADMINISTRATION

Measure U would require an independent annual audit, as is required for all other General Fund revenue. In addition, a Citizens' Oversight Committee will oversee the administration of this Measure. Any reports by the oversight committee or any auditor's report will be public records available to any member of the public for inspection.

EFFECT OF MEASURE

Measure U would provide additional funding for local essential services by collecting a transactions and use tax on the sale of personal property throughout the City. A "Yes" vote is a vote to approve the adoption of an ordinance establishing this tax throughout the City. A "No" vote is a vote to decline this tax.

Measure U will be approved if it receives a simple majority of "Yes" votes.[2]
