Rebecca Simmons-Foley is a resident judge of the 11th Circuit Court in McLean County, Illinois. She was elected on November 6, 2012 to a term that expires in December 2018.[1]

Education

Foley received an undergraduate degree in journalism from the University of Illinois in 1991. She went on to earn a J.D. degree from the DePaul University College of Law in 1995.[2]

Career

From January 2004 until her judicial election in 2010, Foley worked as an associate judge of the 11th Circuit Court.[2][3]

Simmons-Foley was elected to the circuit court without opposition on November 6, 2012. She was unopposed in the Republican primary on March 20, 2012.[1][4]

Misconduct complaint filed against two romantically involved judges (2014)

A complaint filed with the Illinois Judicial Inquiry Board alleged that Judges Scott D. Drazewski and Rebecca Simmons-Foley were involved in an extramarital affair while Foley's husband, a lawyer, was appearing before Drazewski. The complaint said that Drazewski should have disqualified himself from the cases involving Simmons-Foley's husband. It said that Simmons-Foley also violated the rules of conduct for judges by keeping quiet about her colleague's failure to recuse himself when she found out about the situation.

Both judges were separated from their spouses, the complaint explained. Chief Judge Elizabeth A. Robb of the 11th Circuit found out about the affair in 2011 and instructed the judges to limit their contact with each other only to court business. The complaint said that the affair occurred between December 2010 and February 2011.[5]

Hearings occurred October 26-27, 2015.[6] On March 11, 2016, the Illinois Courts Commission ordered Drazewski to serve a four month suspension without pay. Foley received a lesser punishment of being censured.[7]
