On August 31, 2013, Judge Judith Atherton retired from Utah's Third Judicial District Court. Atherton had served on the bench since 1995 and supervised its mental health court since 2004. Before she became a judge, Atherton worked as a staff attorney the Legal Aid Society of Utah then served as a court commissioner. Out of all her legal endeavors, however, none were as meaningful as her service on the mental health court. The Third District's mental health court is the first of its kind in Utah. It provides mentally ill individuals an opportunity to re-enter society instead of languishing in prison without having their illnesses diagnosed and treated. Atherton works with lawyers, social workers, mental health professionals, and jail personnel to supervise and monitor the defendants, who are required to appear in the court regularly, and provide Atherton with an update on their status. Any defendant who fails to adhere to the court's program faces returning to jail. A defendant who completes the program and stays out of trouble graduates from the court and receives a certificate of completion. In describing her tenure on the mental health court, Atherton stated: “ I've heard this said before by other people but it is true. The people I see every Monday afternoon are courageous they are tough, they are living with an illness that we who don't have mental illnesses canʼt understand. Even those of us who are involved in it don't know. We can see it from our own perspective but it is, well its an honor and very… I feel very fortunate to be able to be a part of this process and I guess that's it. ”
