An effort to recall Sheriff Richard Shaffer did not go to a vote in Yellowstone County, Montana, after the Montana Supreme Court held "that it is not enough for a recall petition to allege one of the grounds for recall as set forth in section 2-16-603(3), MCA. The recall petition must also include a clear statement of the alleged acts constituting the grounds for recall. The disputed petition in the case at bar contained no such statement. Consequently, it was defective in form and was properly rejected" in Steadman v. Halland.[1]

The reason for the recall included on the recall petition read, "Sheriff Shaffer acted in a manner to bring discredit to himself and the Department by OFFICIAL MISCONDUCT stemming from an incident in Sweet Grass County on November 7, 1980."[1]
