Robert C. McBurney
Robert C. McBurney is a judge of the Georgia 5th Superior Court District Atlanta Circuit. His current term ends on December 31, 2026.
McBurney ran for re-election for judge of the Georgia 5th Superior Court District Atlanta Circuit. He won in the general election on May 24, 2022.
McBurney was first appointed to the court by Governor Nathan Deal (R) in February 2012 to succeed Marvin S. Arrington.[1]

Education
McBurney received his undergraduate degree from Harvard College in 1990 and his J.D. from Harvard Law School in 1995.[2]
Career
Prior to joining the court, McBurney was senior counsel for the U.S. Attorney's Office for the Northern District of Georgia. He also served as the Fulton County Assistant District Attorney.[2]

Selection method
There are 202 judges on the Georgia Superior Courts, each chosen by the people in nonpartisan elections to serve a four-year term.
The process for selecting a chief judge and that chief judge's term varies by circuit.[3]
Qualifications
To serve on this court, a judge must be:
- a state resident for three years;
- a resident of the circuit he or she is representing;
- admitted to practice law for at least seven years; and
- at least 30 years old.

Presided over grand jury investigation of possible criminal interference in the 2020 presidential election in Georgia (2023)
McBurney presided over a grand jury investigation of possible criminal interference in the 2020 presidential election in Georgia. The grand jury was convened in Fulton County, Georgia, in May 2022.[4] Former President Donald Trump (R) was a subject of the investigation, among others.[5]
In an interview with CBS News McBurney commented on his experience presiding over the grand jury. McBurney said, "It's special, it's different and I've never had to deal with [a special purpose grand jury investigation] before. [...] I was able to work with good lawyers from the District Attorney's office, from many of the witnesses, grappling with new issues and I always like that — to avoid the sameness that a judge can encounter with some of the repetitious nature of criminal and civil cases."[6]
