Judge allows recall election to proceed
On July 18, 2013, Judge Hyatt approved the first-ever legislative recall election, rejecting a lawsuit intended to stop the recall. A date of September 10, 2013 has been set for the recall election of Democratic Senators John Morse and Angela Giron. The opposition to the two senators stems from their votes in favor of three gun-control bills.[3] In his ruling, Hyatt stated:
“ | The court specifically finds that the recall process involves fundamental rights of a republican form of government which the people have reserved onto themselves… And any such law ‘must be liberally construed in favor of the right of the people to exercise that...'[4][5] | ” |
