Robert J. Lemkau was a judge for the Superior Court of San Bernardino County in California.[1] He was appointed by Governor Arnold Schwarzenegger in 2007 and lost his seat in the 2010 election.[2][3][4]

2010 election
On January 21, 2010, Katie Tagle appeared before Judge Lemkau, seeking a restraining order against Stephen Garcia, the father of her nine-year-old son. She claimed Garcia had threatened her, the boy and other family members. Lamkau refused to issue the restraining order. According to court transcripts, the judge did not find sufficient evidence. He said, "Mr. Garcia claims it’s a total fabrication on your part.” Lemkau added, "My supposition, ma'am, is that you're lying."[5] Ten days later, Garcia reportedly killed his son and himself.
James J. Hosking, the prosecutor in the case, subsequently ran for Lemkau's seat. He filed just 48 hours before the deadline.[6] Lemkau lost to Hosking in the primary election, winning only 44 percent of the vote.[7]
