Drunk driving arrest

Mecklenborg was arrested in Indiana early on April 23, charged with drunk driving. A state trooper initially pulled him over for a burned-out headlight, but according to the report he smelled alcohol on Mecklenborg's breath. When the representative failed three field sobriety tests and refused a chemical test, the trooper appealed to a judge, who ordered a warrant for a blood test. Mecklenborg's blood-alcohol level registered a 0.097 percent; the legal limit in both Indiana and Ohio is 0.08.[11] He pleaded not guilty to the charge and is scheduled to appear in court on July 26.[12]

In a phone conversation with local media, Mecklenborg said "while the discovery process of this case goes on, I am entitled to the same presumption of innocence as any other citizen." In late June, Mecklenborg fell under further scrutiny from House leadership for failing to report the arrest to fellow legislators. House Speaker William G. Batchelder said he was "shocked and disappointed."[13]
