Recall reports

An effort in Petersburg, Virginia, to recall Mayor Samuel Parham and Councilman W. Howard Myers from their positions was initiated in November 2016. Clean Sweep Petersburg filed petitions against Parham and Myers in circuit court on January 20, 2017.[1] Judge Joseph M. Teefey heard the recall case on February 6, 2017.[2] Teefey dismissed the petitions against Parham and Myers after organizers agreed to withdraw the effort. Recall supporters withdrew their petitions because they did not contain comprehensive lists of charges against the targeted officials and an acknowledgment that false information could lead to perjury charges.[3]

Recall supporters

Clean Sweep Petersburg pursued a recall against Parham and Myers over accusations of state law violations. These accusations included failing to adhere to the state's Freedom of Information Act, voting on city business without public hearings, and withholding information on public matters.[1]

Virginia's recall law allows citizens to submit petitions to circuit court judges in order to initiate recall efforts. Targeted officials have 10 days following submission to issue responses to petitioners. A court hearing is held to determine if a targeted official has engaged in misconduct while in office. The term misconduct refers to neglect of duty, misuse of public office, or criminal conviction. If a judge finds a targeted official engaged in misconduct, the official is removed from office.[1]
