Judge Donald Alvarez of the San Bernardino County Superior Court ruled that Measure K was unconstitutional on August 31, 2021. He wrote that the measure's one-term limit violated the First Amendment and the Fourteenth Amendment. He also stated that the term limit provision was not separable from the rest of the measure; therefore, the measure as a whole could not be enforced. [1]
The organization Red Brennan Group, which backed the initiative, filed an appeal on September 22, 2021.[2]
