A recall election against District 2 representative Leonard Moty on the Shasta County Board of Supervisors in California was scheduled for February 1, 2022.[1] Moty was recalled with 56% of voters in favor of the recall. Tim Garman defeated Dale Ball, Tony Hayward, and Tarick Mahmoud in the recall replacement race.[2]
The recall effort began in April 2021 and was initially against three of the five members of the board.[3] District 1 representative Joe Chimenti and District 3 representative Mary Rickert were named along with Moty in the notices of intent to recall.[4][5] Recall supporters filed signatures for the recall against Moty by the deadline on September 29, 2021. They did not submit signatures for the other two commissioners.[6]
Chimenti, Moty, and Rickert voted to censure the other two members of the board, Les Baugh and Patrick Jones, on February 2, 2021, for opening the board chambers to the public on January 5, 2021. Opening the chambers defied the county's order to ban in-person meetings in response to the COVID-19 pandemic. Since then, the chambers had been opened with a capacity limit.[7] On March 23, 2021, the board voted 3-2—with Chimenti, Moty, and Rickert in favor—to continue using the state's colored tier system for COVID-19 pandemic regulations.[8]
Chimenti was first elected to a four-year term on the board in 2018, defeating incumbent David Kehoe with 55% of the vote.[9] Moty and Rickert were both re-elected to four-year terms on the board on November 3, 2020. Moty received 51% of the vote, defeating two challengers, and Rickert won re-election unopposed. Moty was first elected to the board in 2008, and Rickert first was elected to the board in 2016.[10][11]

Recall supporters cited the following reasons for recall when they read the notices of intent to recall at a board meeting on April 6, 2021:[12]

Elissa McEuen, a recall supporter, said during a board meeting on April 6, 2021, that the three supervisors had failed to stand up to Governor Gavin Newsom (D) and withdraw from the state's colored tier system for COVID-19 pandemic regulations. She also said they were being held accountable for disregarding residents' wishes.[4]
"This is not personal. This is responsible citizenship," McEuen said. "These supervisors have performed poorly at reflecting the will of the residents of Shasta County. Therefore, a recall has become necessary to determine which supervisors continue to enjoy the support of their community and which ones need to be replaced."[4]
The other two members of the board—Les Baugh and Patrick Jones—voiced their support of the recall.[14]
Recall opponents
After the recall election was scheduled, Moty said he would defend his position. “Now is not the time to tear us apart as some has sought,” Moty said. “But rather it's a time to move our county forward. I will say here and now, I refuse to allow personal attacks on myself, my family, dedicated county workers, and courageous citizens by those who would halt our progress in our county.”[1]
Before the recall effort became official, Moty said, "This is an attempt by extremists, who can't get their way, to try a recall effort through character assassination. They only want what's best for themselves and not the whole community."[15]
Rickert said, "It's an expensive process and in my opinion, I would much rather that money be spent on public safety in our rural communities."[15]
At a board meeting in March 2021, Chimenti spoke in defense of the board's actions in response to the COVID-19 pandemic. “Unlike many other counties around California, this board has never enacted any ordinance and we have never burdened law enforcement with enforcement responsibilities pertaining to the COVID-19 pandemic,” Chimenti said. “We promote enforcement through education, and we rely on the intelligence, common sense and community commitment of the citizens of Shasta County to fight against this contagious, deadly virus.”[7]

The first notices of intent to recall were rejected by the Shasta County Clerk for not including the signatures of the proponents, which is required by Election Code 11022.[16] Recall supporters submitted new notices on April 30, 2021.[3]
The Shasta County Elections Office approved the new notices of intent to recall as well as the recall petitions. Supporters had 120 days to collect signatures equal to 20% of registered voters in each district the supervisors represent. To get the recalls on the ballot, the petition against Chimenti needed 4,392 signatures, the petition against Moty needed 4,308 signatures, and the petition against Rickert needed 4,432 signatures. The petition filing deadline was September 29, 2021.[7][8][17] Recall supporters filed signatures against Moty by the deadline, but they did not file signatures against Chimenti and Rickert.[6] The Shasta County Clerk announced on October 21, 2022, that enough signatures had been verified to schedule a recall election.[18] The Shasta County Board of Supervisors unanimously voted to schedule the recall election for February 1, 2022.[1] The candidate filing deadline was November 17, 2021.[19]
Recall supporters filed a lawsuit in Shasta County Superior Court on September 14, 2021, asking for a deadline extension to circulate petitions. They said smoke from multiple fires impeded their ability to collect signatures.[20] They requested a 32-day extension. A hearing on the request was held on September 28, 2021.[21] Shasta County Superior Court Judge Tamara Wood denied the extension request.[22]
Ballotpedia covered 35 coronavirus-related recall efforts against 94 officials in 2022, accounting for 13% of recalls that year. This is a decrease from both 2020 and 2021. COVID-related recalls accounted for 37% of all recall efforts in both 2020 and 2021. In 2020, there were 87 COVID-related recalls against 89 officials, and in 2021, there were 131 against 214 officials.
