The South Dakota Director of Insurance's powers, term of office, etc. are derived from Title 58, Chapter 2 of the South Dakota Statutes.

Article X, Section Y:

58-2-1.1. Department as Division within Department of Labor and Regulation--Direction and supervision by department--Independent functions retained by division.
The Division of Insurance shall be administered under the direction and supervision of the Department of Labor and Regulation (hereinafter referred to as "department") and the secretary of labor and regulation (hereinafter referred to as "secretary"), but shall retain the quasi-judicial, quasi-legislative, advisory, and other nonadministrative functions (as defined in § 1-32-1) otherwise vested in it and shall exercise those functions independently of the secretary.[2]

58-2-2.1. Appointment of director--Removal.

The director of the Division of Insurance shall be appointed...[3]

Qualifications

Title 58, Chapter 2, Section 3 of the South Dakota Statutes establishes the qualifications of the office:

58-2-3. Qualifications of director.
The director must have had at least five years of practical experience in one or more of the types of insurance business subject to regulation by the director, or have had other professional and business experience reasonably adequate in character and scope to equip him to discharge the duties and fulfill the responsibilities of the office of director.[4]
