The South Dakota Militia Gender and Age Restrictions Removal Amendment, SJR 2, was not put on the ballot in South Dakota as a legislatively referred constitutional amendment on November 6, 2018.[1]

Senate Joint Resolution 2 (SJR 2) would have amended the state constitution to remove gender and age specifications from the constitutional provisions regarding the state's militia.[2]

The measure would have amended section 2 of Article XV of the state constitution. The following underlined text would have been added, and struck-through text would have beeen deleted:[2]

The militia of the state of South Dakota shall consist of all any adult able-bodied male persons person legally residing in the state, between the ages of eighteen and forty-five years, except such persons as now are, or hereafter may be, any person who is exempted by the laws of the United States or of this state.[3]

A simple majority vote of all members in each chamber of the South Dakota State Legislature in one legislative session is required to put a constitutional amendment before voters. This proposal was drafted and approved by the interim task force on the state's initiative and referendum process. It was introduced in the Senate as Senate Joint Resolution 1 (SJR 1).

Senate Joint Resolution 2 was first read by the Senate on January 17, 2018, and referred to the State Affairs Committee, which approved it 7-2. The Senate amended it from "...person residing in the state..." to "...person legally residing in the state..." and approved the amended version 29-3 on January 25, 2018. All Republicans except for three that were excused voted in favor of it; three Democrats voted in favor of it, and three voted against it.[1]
