He was appointed to this position by Democratic Governor Martin O'Malley on December 22, 2011, to succeed Judge Ellen Hollander.

The Maryland Court of Special Appeals became the Appellate Court of Maryland, following a 2022 constitutional amendment that changed the court's name.[1]

Berger received his B.A. in economics from Bucknell University, graduating cum laude in 1981, and his J.D. from the University of Baltimore School of Law in 1984.[2]
