Five seats on the Sweetwater Union High School District Board of Education were up for general election on November 4, 2014. Seats from Trustee Areas 1, 3 and 5 were up for election to four-year terms, and seats from Trustee Areas 2 and 4 were up for election to two-year terms.[1]
Newcomers to the board were elected in all five areas. Arturo Solis won the Trustee Area 1 seat, Kevin J. Pike won the Trustee Area 2 seat, and Frank A. Tarantino won the Trustee Area 3 seat. In Trustee Area 4, Nicholas Segura was elected, and the Trustee Area 5 seat was won by Paula Hall.[2]
The spring of 2014 brought a sweep of convictions of elected officials, administrators and contractors in southern California school districts that left the Sweetwater Union Board of Education with one remaining member, board president John McCann, who finished his term through November 2014. Four members of the San Diego County Board of Education stepped in to serve as interim board members until new members were elected on November 4, 2014.[3]
McCann did not file to run for re-election, but former members Bertha J. Lopez and Jim Cartmill, both of whom pleaded guilty to misdemeanors of accepting gifts above the state limit while serving on the school board, ran to reclaim their seats. They were both defeated on November 4, 2014.[2][3] A total of 21 candidates ran for the five open seats.[4]
About the district
Sweetwater Union High School District is located in San Diego County, California. The county seat of San Diego County is San Diego. San Diego County is home to 3,211,252 residents, according to the United States Census Bureau.[5] In the 2011-2012 school year, Sweetwater Union High School District was the 16th-largest school district by enrollment in California and served 40,619 students.[6]
Demographics
San Diego County outperformed the rest of California in terms of higher education achievement in 2012. The United States Census Bureau found that 34.4 percent of San Diego County residents aged 25 years and older had attained a bachelor's degree compared to 30.5 percent for California as a whole. The median household income for San Diego County was $63,373 compared to $61,400 for the entire state. The percentage of people below poverty level for San Diego County was 13.9 percent while it was 15.3 percent statewide.[5]

Voter and candidate information
The Sweetwater Union High School District Board of Education consists of five members elected to four-year terms by specific geographic areas. There was no primary election, and the general election was held on November 4, 2014. The seats from Trustee Areas 1, 3 and 5 were up for election to four-year terms, and the seats from Trustee Areas 2 and 4 were up for election to two-year terms.[1][11]
School board candidates had to file with their county elections department during the candidate filing period. The filing period began July 14, 2014, and ended August 8, 2014. To vote in the 2014 general election, voters had to register by October 20, 2014. Voters could request vote-by-mail ballots from October 6, 2014, through October 28, 2014.[12]

Endorsements
The Republican Party of San Diego County endorsed Burt Grossman (Area 1), Kevin J. Pike (Area 2), Richard F. Arroyo (Area 3), Derrick W. Roach (Area 4) and William "Bud" McLeroy (Area 5).[13]
The Democratic Party of San Diego County endorsed Arturo Solis (Area 1), Adrian Arancibia (Area 2), Frank A. Tarantino (Area 3), Nicholas Segura (Area 4) and Paula Hall (Area 5).[14]
Campaign finance
Candidates had to file contribution reports within 24 hours of receiving an aggregate total of $1,000 or more from a single source. The first scheduled pre-election report filing deadline was October 6, 2014. If candidates raised or spent less than $1,000 during the 2013 and 2014 calendar years, they had to file Form 470 at that time. If candidates raised or spent more during that time, they had to file Form 460 by the pre-election report filing deadline.[15]
Candidates required to file Form 460 also had to file a second pre-election report on October 23, 2014, and they had to file termination reports by December 31, 2014. If a termination report was not filed, candidates had to file a semi-annual report by February 2, 2015.[15]

According to the first pre-election reports submitted to the San Diego County Registrar of Voters, candidates for Trustee Area 1 reported a total of $1,906.36 in contributions and $1,201.36 in expenditures as of September 30, 2014. Only one candidate, Jerome Orlando Torres, filed Form 470 to indicate he would not be spending or receiving more than $1,000 in this election. Because of that, Torres did not have to file any additional campaign finance reports.[16][17][18]

Only one candidate for Trustee Area 4, Nicholas Segura, indicated that he would be spending or receiving more than $1,000 in this election. The other three candidates, Marcelino J. Martinez, William "Bud" McLeroy and Thomas "Tom" Schaaf filed Form 470 to indicate they would not be spending or receiving more than $1,000 in this election. Former members, ousted after misdemeanor convictions, run to reclaim seats
Bertha J. Lopez and Jim Cartmill pleaded guilty to one misdemeanor each in April 2014, after accepting gifts above the state limit while serving on the Sweetwater Union Board of Education. After being sentenced in June to three years’ probation, 40 hours of community service and a $4,589 fine, a San Diego Superior Court judge ruled that both of their seats had become vacant. The ruling was based on Government Code 1770, which states that any conviction involving an offense that violated official duties of an elected office creates an immediate vacancy in that office. The code did not stop Lopez and Cartmill from running for office again. Both former members filed to reclaim their seats in the general election on November 4, 2014.[3] They were both defeated by newcomers to the board.[2]
Two other members of the Sweetwater Union Board of Education were involved in a sweep of convictions in southern California school districts in the spring of 2014, leaving only one board member left for the district, former board president John McCann. The San Diego County Board of Education stepped in to fill the vacancies created by the convictions until the election determined the new members. McCann did not file for re-election.[3]
Issues in the district
Title IX class action lawsuit upheld
The Sweetwater Union High School District was in violation of Title IX, the federal law that prohibits gender discrimination in education and public school athletic programs, ruled the Ninth U.S. Circuit Court of Appeals on September 19, 2014. The district was also charged to have engaged in unlawful retaliation under Title IX. The ruling upheld a lower court ruling in favor of a lawsuit filed in 2007 on behalf of female students in the district.[37]
In 2012, U.S. District Court Judge M. James Lorenz ruled that female student athletes at Castle Park High School been denied the equal opportunity to play high school sports as they had inferior facilities and less opportunities to play compared to male student athletes. Lorenz also ruled that the district was in violation of Title IX in many other aspects, including coaching benefits and publicity.[38]
The unlawful retaliation charge came from the district's firing of softball coach Chris Martinez after he had complained to Castle Park High School's administrators about the girls' facilities. The court ruled that the school's female softball team had been stronger with Martinez as a coach.[37]
The district paid almost $500,000 in legal fees during the first round of court proceedings and a further $100,000 to appeal the decision. Since the lawsuit was filed, the district has spent $1.6 million to improve its softball fields.[38]
