The Texas Energy Commission Amendment was not on the November 3, 2015 ballot in Texas as a legislatively referred constitutional amendment. The measure, upon voter approval, would have renamed the "Texas Railroad Commission" to "Texas Energy Commission."[1]

The measure was introduced into the Texas Legislature by Rep. Larry Phillips (R-62) as House Joint Resolution 76.[2]

The constitutional amendment to change the name of the Railroad Commission of Texas to the Texas Energy Commission.[3]

The proposed amendment would have amended Section 30(b) of Article 16 of the Texas Constitution. The following struck-through text would have been deleted and the underlined text would have been added by the proposed measure's approval:[1]

When a Texas Energy Railroad Commission is created by law it shall be composed of three Commissioners who shall be elected by the people at a general election for State officers, and their terms of office shall be six years. And one Railroad Commissioner shall be elected every two years. In case of vacancy in said office the Governor of the State shall fill said vacancy by appointment until the next general election.[3]

The proposed constitutional amendment was filed by Rep. Larry Phillips (R-62) as House Joint Resolution 76 on February 3, 2015.[2] A two-thirds vote in both chambers of the Texas State Legislature was required to refer the amendment to the ballot. Texas is one of 16 states that require a two-thirds supermajority vote in both chambers.
