The Texas State Highway Fund Amendment, also known as Senate Joint Resolution 5, did not make the November 5, 2013 general election ballot in the state of Texas as a legislatively referred constitutional amendment. The measure would have allowed residents in the state to decide on whether or not they purchase health care insurance. The measure stemed from the events surrounding the Affordable Health Care Act. The author of the bill was State Senator Donna Campbell.[1]

According to the bill's text, the ballot language would have read as follows:[1]
| “ | The constitutional amendment providing individuals the right to choose or decline to choose to purchase health insurance coverage without penalty or sanction or threat of penalty or sanction.[2] | ” |
Path to the ballot
A 2/3rds vote in both chambers of the Texas State Legislature is required to refer an amendment to the ballot. Texas is one of sixteen states that requires this.
