The Texas Prohibit Sales Tax on Water Amendment, also known as SJR 36, was not on the ballot in Texas as a legislatively referred constitutional amendment on November 7, 2017.
The measure would have prohibited the state from levying a tax on the sale or purchase of water at wholesale.[1]
As of 2017, Texas did not levy a sales tax on water.[2]

In Texas, a two-thirds vote in both chambers of the Texas State Legislature during one legislative session is required to refer a constitutional amendment to the ballot. Texas is one of 16 states that require a two-thirds supermajority vote in both chambers.
Sen. Charles Perry (R-28) filed the amendment in the state legislature as Senate Joint Resolution 36 (SJR 36) on January 30, 2017. The Senate approved the amendment on April 20, 2017. All 31 members of the Senate voted in favor of the bill. The measure was referred to the House Ways & Means Committee, where it did not receive a vote.[4]
