The 2014 Texas judicial elections included races for spots on the state's two high courts, as well as hundreds of races for the lower courts. Candidates ran in partisan elections. Republican candidates won most of the judicial races across the state.</nowiki>
All of the winning candidates for the Texas Supreme Court and Texas Court of Criminal Appeals were Republican, and all of the incumbents who ran for those courts were successful.

Process
Primary election
Partisan primaries are held if even one candidate has filed for a position. To advance to the general election, a candidate must win a majority (over 50 percent) of the vote. If no candidate in a race wins the majority—as in cases where more than two candidates are competing for a seat—a runoff election is held between the top two candidates.[2][3]
Though Texas officially has closed primaries (requiring that voters declare party affiliation in advance in order to participate), the state's primaries are functionally open; any registered voter may vote in any single party's primary if they have not voted in the primary of another party. The elections are closed, however, in that voters may not participate in the proceedings (a runoff primary or a convention) of another party thereafter.[2]
General election
The winning candidates from each major party's primary, as well as any additional minor party candidates, compete in a general election on the first Tuesday after the first Monday in November. If a candidate was unopposed in the general election, his or her name will still appear on the general election ballot.[2][4]

Judge Guy Herman of the Travis County Probate Court in Texas retired from the bench on September 22, 2014. As he was running unopposed for re-election in November 2014, he was set to return to the court in January 2015. Herman stated he planned to use the three-month retirement period to travel, exercise, and study Spanish.[5] Herman described the arrangement as unconventional but said it would reduce taxpayer costs and allow him time off from judicial duties. However, it was not immediately clear whether Herman would be eligible to receive retirement benefits during this period. Federal tax rules prohibit employees from receiving retirement benefits if they have an agreement to return to the same job. Violations could result in the return of benefits or the potential disqualification of the county retirement plan by the IRS.[5] Herman's attorney, Buck Wood, said that running for re-election likely would not be considered an agreement with an employer under the rule. He acknowledged the possibility of a dispute with the IRS but said it was unlikely to become a significant issue.[5] According to the Texas County and District Retirement System, a "bona fide termination" is required for benefits to be granted. A guaranteed return to office through an unopposed election may not meet that standard.[5] An interim judge was appointed during Herman’s absence. Herman, whose annual salary was $196,367, said an interim judge would cost less than a visiting judge, who would be paid $627 per day plus travel reimbursements.[5] The Travis County Commissioners Court unanimously approved Herman’s resignation on September 9, 2014, and appointed Associate Probate Judge Dan Prashner as interim judge. Prashner’s salary was increased from $115,360 to $158,000. He was expected to serve until Herman resumed the bench in January.[5][6] |

A rural Texas county marked a milestone with the election of its first female county judge. The judicial primaries on March 4 resulted in a win for Republican Mary S. Cunningham, who then ran unopposed in the general election for the Llano County Court in November. Cunningham had moved to Llano from Houston years earlier to work as a court-appointed attorney for the 434rd and 33rd judicial districts.[7] Cunningham described the community as more welcoming than she expected, saying the residents valued capability and fiscal responsibility.[7]
Nearby Burnet County also had female elected officials, including county judges like Donna S. Klaeger and mayors such as Nona Fox. Fox said, "I think we have great female leaders. I think attitude has a lot to do with it—attitude and desire."[7] Women have held leadership roles in these counties since the early 20th century, such as Ophelia "Birdie" Crosby Harwood, who was elected chief magistrate of Marble Falls in 1917 and appointed municipal judge in 1935.[7] |

The runoff for Llano County Justice of the Peace Court in Texas resulted in a tie, requiring a coin toss to determine the winner.[9][10] Republicans Linda Ballard and Steve Lange each received 371 votes in the May 27 runoff, a result confirmed by a recount. Texas law required that the winner be selected through a "casting of lots."[9][10] Republican Chair Jim Simmons officiated the coin toss at the courthouse gazebo. Lange called tails, but the coin came up heads, securing the win for Ballard, the incumbent. Ballard was unopposed in the general election.[9] |

The Texas 2014 primary runoff elections concluded on Tuesday, May 27.[11] Results included: Of the 20 district judges in runoffs, three were incumbents (including Denise Pratt, who resigned before the election but remained on the ballot). Only Juan Partida of the 275th District advanced to the general election.[12][13] The closest district court race was between John Bustamante and Laura Flores Macom (45th District), decided by a 1.3% margin.[14] The widest margin occurred in the 311th District, where Alicia Franklin York won with 77.4% after Denise Pratt’s withdrawal.[15] El Paso County had the most judicial runoffs (six), followed by Bexar County (five), Cameron County (four), and Dallas County (four). |

A winner was confirmed in a Texas county court race previously reported in last week's Election Brief.[16] Shelby County incumbent Rick Campbell requested a recount after initially losing by one vote in the March 4, 2014 primary. Opponent Allison Harbison, supported by voters concerned about a recently closed medical facility, had 1,629 votes to Campbell's 1,628. The outcome depended on the recount and the counting of five provisional ballots.[16] Of the five provisional ballots, Campbell and Harbison each received one, leaving the margin unchanged. Though Harbison took office after the November general election, the absence of a Democratic challenger ensured she would succeed to the Shelby County Court judgeship.[16] Regarding provisional voting, the Texas Secretary of State explains on VoteTexas.gov that

In the Shelby County primary election, Judge Rick Campbell trailed newcomer Allison Harbison by one vote.[18] Residents of Center, Texas, cast 1,628 votes for Campbell and 1,629 for Harbison in the March 4 Republican primary. Campbell requested a recount and inclusion of five provisional ballots still under review.[18] Campbell said,
The contest reflected community concerns about the closure of the Shelby County Medical Center in summer 2013. Following the closure, a toddler, Edith Gonzalez, was rushed there but could not be saved. Harbison received support from women and local medical professionals who felt Campbell had not adequately addressed the issue.[18] Campbell attributed challenges to limited funding and expressed opposition to government involvement in private healthcare, encouraging residents to develop their own solutions.[18] Community member Kathy Hagler, who gathered 1,500 signatures to reopen the center, supported Harbison’s campaign and said she hoped for Harbison’s victory.[18] Harbison had served as a county clerk for 14 years. Campbell’s family has a long history in Shelby County politics. He is also a businessman and cattleman.[18] |

Judicial positions on the Supreme Court of Texas and the Court of Criminal Appeals are partisan and determined by primary elections. Four seats on the Supreme Court of Texas were up for election in 2014. All four Republican incumbents retained their party nominations: Nathan Hecht, Chief Justice, defeated challenger Robert Talton with 60.4% of the vote. Joe Pool, Jr. sought nomination again but was defeated by Jeff Brown, who received 71% of votes.[19] Phil Johnson defeated challenger Sharon McCally 64% to 36%. Jeff Boyd was unopposed. Primary voter turnout in Supreme Court races was approximately 7-9% of registered Republicans.[20] Currently, the Supreme Court consists entirely of Republicans, but three Democratic candidates will challenge incumbents in November. All three Democrats faced no opposition in their primaries and will advance to the general election: Bill Moody, Larry Meyers, and Gina Benavides.[21] |

The 2014 primary was key in the three races for the Texas Court of Criminal Appeals. With no incumbents running, the Republican nomination was competitive. All three Republican nominees are favored to win the general election. For Place 3, Bert Richardson defeated Barbara Walther with about 60% of the vote. Place 4 had three Republican candidates: Richard Dean Davis, Jani Jo Wood, and Kevin Patrick Yeary. Yeary won with approximately 55%, avoiding a runoff. Place 9 was closely contested, with David Newell defeating William "Bud" Kirkendall by about 52%. All seats on the Court of Criminal Appeals are held by Republicans except that of Lawrence Meyers, who switched to the Democratic party to run for the Supreme Court this year. Only Place 3 features a Democratic candidate, John Granberg, who will face Republican Bert Richardson and Libertarian Mark Bennett in the general election. David Newell (Place 9) and Kevin Patrick Yeary (Place 4) face no Democratic opposition. Green and Libertarian candidates are also running.[22] |

The judicial primaries in Jefferson County, Texas, produced three runoff elections.[23] For the Jefferson County Court at Law No. 3, four candidates ran in the primary. The sole Republican, Clint M. Woods, advanced to the general election. The runoff will decide the Democratic candidate to face Woods. Audwin Samuel, Jimmy D. Hamm, and Terrence L. Holmes ran in the Democratic primary. Hamm was eliminated with 20.4% of the vote; Samuel and Holmes will face off in the runoff on May 27. A runoff also will determine the Democratic candidate for the 252nd District Court. Raquel West, Stella Batiste Morrison, and Nathan Reynolds Jr. competed in the Democratic primary without a majority winner. West (38.6%) and Morrison (31.5%) will advance to the runoff; Reynolds (29.9%) was eliminated. The winner will face Republican Carolyn Drawhorn Wiedenfeld in November. Finally, the Jefferson County Justice Court Precinct 8 race will feature a runoff between incumbent Tom Gillam III and challenger Kenneth W. Marks. Gillam received 45.6%, nearly twice Marks’ 23.2%, but no candidate reached 50%. No Republicans filed for this race. |

Nancy Tanner emerged from the March 4 primary election as the Republican nominee for Texas’s Potter County Court judgeship, avoiding a runoff with 50.49% of the vote.[24] Tanner was one of five candidates seeking to replace retiring Judge Arthur Ware, who stepped down following a stroke in 2010. The final margin of victory was just enough to avoid a runoff between Tanner and fellow Republican Bill Bandy.[24] Commented Tanner,
Tanner, Bandy, Debra McCartt, Jeff Poindexter, and William Sumerford all ran in the Republican primary. None had previous legal experience. No Democratic candidate filed for the general election, meaning Tanner was expected to take office unless a recount changed the result. A recount would have required Bandy to pay a $100-per-precinct deposit, totaling $1,600 in Potter County.[24] Tanner said she planned to meet with officials and department heads to prepare for the role, stating,

In 2014, three seats on the Texas Court of Criminal Appeals were up for election due to retirements of Judges Tom Price, Paul Womack, and Cathy Cochran, all Republicans.[26] Some observers noted the court's direction could be influenced by these changes. Jennifer Laurin, a law professor at the University of Texas, said, "These are frequently three judges who have made the difference one way or another, particularly where the court has tended to rule in a more defense-favored way."[27] Brian Wice, a defense attorney, also viewed them as "winnable votes for the defense." However, Michael Casillas, a Dallas County prosecutor, said the judges aimed to be “very measured” in their rulings.[27] The Republican primary was decisive in two of the three races, as no Democratic candidates filed for Places 4 or 9. Only Place 3 featured a general election contest, with Republican Bert Richardson facing Democrat John Granberg. In the Victoria County Court primary, incumbent Donald R. Pozzi sought a fourth term, facing challenger Ben Zeller, a loan supervisor.[28] Pozzi raised over $96,000 in campaign funds, compared to Zeller’s reported $19,000. Zeller described his effort as grassroots, using social media and volunteers, and loaned his campaign $15,000.[28] Pozzi, then 70, emphasized his years of experience. Zeller, at 29, argued that qualifications depend on accomplishments, not age. His platform included tax reductions and greater transparency. Pozzi’s campaign treasurer praised his leadership over the past 12 years.[29] |

Judge Lawrence "Larry" Meyers of the Texas Court of Criminal Appeals switched from the Republican Party to the Democratic Party to run for the Texas Supreme Court in 2014, making him the first statewide Democratic officeholder in Texas in over a decade.[34] Texas Democratic Party Chairman Gilberto Hinojosa welcomed the move, while Republican Party executive director Beth Cubriel pointed to the higher number of party switchers moving in the opposite direction.[34] Meyers ran for Place 6 on the supreme court.
