This month's Federal Vacancy Count includes nominations, confirmations and vacancies from September 30, 2015, to October 27, 2015. Nominations, confirmations and vacancies occurring on October 28, 2015, will be reflected in the November 25 report.

The vacancy warning level remained at blue this month after one vacancy and three new confirmations. The vacancy percentage fell to 7.4 percent. There were no new nominations this month, allowing the total number of nominees waiting for confirmation to fall to 29. The number of vacancies of Article III judges fell to 65 out of 874. New vacancies

U.S. District Court for the District of Rhode Island

Mary Lisi is a federal judge on senior status for the U.S. District Court for the District of Rhode Island. She joined the court in 1994, after being nominated by former President Bill Clinton. At the time of appointment, she was the chief disciplinary counsel for the Rhode Island Supreme Court. Lisi was the chief judge of the court from 2006 to 2013. Lisi's transition on October 1, 2015, brought the vacancy total on the U.S. District Court for the District of Rhode Island to one. This changes the vacancy warning level from green to orange.[1][2]

New confirmations

United States District Court for the Eastern District of California

Dale A. Drozd

Dale A. Drozd is a federal judge for the United States District Court for the Eastern District of California. President Barack Obama nominated Drozd to the Eastern District of California on November 12, 2014. Drozd's nomination was confirmed by the Senate on October 5, 2015. Drozd's transition filled the only vacancy on the United States District Court for the Eastern District of California. This changes the vacancy warning level from yellow to green.[3][4]

United States District Court for the Eastern District of New York

Ann M. Donnelly

Ann M. Donnelly is a judge for the United States District Court for the Eastern District of New York. President Barack Obama nominated Donnelly to the United States District Court for the Eastern District of New York on November 20, 2014. She was confirmed to the position on October 20, 2015. Donnelly's transition reduced the vacancies on the United States District Court for the Eastern District of New York from three to two. The vacancy level remained at yellow.[5][4]

United States District Court for the Western District of New York

Lawrence Joseph Vilardo

Lawrence Joseph Vilardo is a federal judge for the United States District Court for the Western District of New York. President Barack Obama nominated Vilardo to the United States District Court for the Western District of New York on February 4, 2015. His nomination was confirmed by the Senate on October 26, 2015. Vilardo's transition filled a vacancy, leaving one remaining vacancy on the United States District Court for the Western District of New York. This changes the vacancy warning level from red to yellow.[5][4]
