Approach to the law

According to an article appearing in The Record, the journal published by the Florida Bar's Appellate Practice Section, Judge Osterhaus believes in "judicial restraint."[5] He feels judges must understand the boundaries proscribed by the law, which includes the state and federal constitutions, statutes, and binding case law, as well as the limited role the judiciary performs in carrying out our system of government. Upon appointing Judge Osterhaus to the First District Court of Appeal, Governor Scott said, "[Osterhaus] is a diligent and careful constitutional lawyer who respects the rule of law and the separation of powers."[5]
