A Town of Paonia Marijuana Retail Legalization Referendum, Measure 2B ballot question was on the November 4, 2014 election ballot for voters in the town of Paonia in Delta County, Colorado, where it was defeated.

If approved, this measure would have made it legal, according to town law, to operate retail marijuana establishments, including retail marijuana cultivation facilities, marijuana product manufacturing facilities, testing facilities and marijuana stores.[1]

Background

In 2010, Paonia voters approved a measure banning all retail marijuana in the town. The measure banning marijuana sales passed by a margin of 16 votes, which amounted to less than 1 percent of town voters.[2]

Mayor Neal Schwieterman, who was the tie-breaker in a dead even town board of trustees vote to approve the language of this ballot question, said, "The last election, where the medical marijuana retail establishments were banned from town, lost by 16 votes, which is .94 percent of our electorate. I don’t know how to vote representing this community...because it’s so close to 50 percent. I couldn’t venture a guess. I’ve always advocated for putting it on the ballot so the voters can decide."[2]

The question on the ballot appeared as:[1]

Shall the establishment and operation of retail marijuana cultivation facilities, retail marijuana product manufacturing facilities, retail marijuana testing facilities and retail marijuana stores (collectively called ‘Retail Marijuana Establishments’) be permitted in the Town of Paonia, Colorado subject to the requirements of the Colorado Retail Marijuana Code and regulations to be adopted by the Board of Trustees of the Town of Paonia?[3]
