The Judicial Update

May 29, 2012

Bridgeport, Connecticut: Two lawyers are waiting on the decision from a state judge whether or not they will be able to withdraw from a case involving a convicted triple murderer.[1]

Richard Roszkowski was convicted and condemned to death in 2009 for fatally shooting 39-year-old Holly Flannery, 38-year-old Thomas Gaudet, and Flannery's 9-year-old daughter Kylie Flannery in the Bridgeport area in 2006.[1]

Though convicted and condemned to death in 2009, a new penalty phase was ordered for the Roszkowski case because of a mistake made by a judge during the instructions to the jury.[1]

A pre-trial hearing in the Bridgeport Superior Court is set for May 30, 2012, and the penalty phase of the trial will be the determining factor in whether or not Roszkowski should be sentenced to death.[1]

Roszkowski's lawyers have reported difficulties in working with him on his defense for the case, and Judge Robert Devlin Jr. has stated the he will most likely approve the withdrawal of Roszkowski's lawyers and will be appointing another attorney for the case for the May 30, 2012 hearing.[1]
