Riverside violation of Proposition 218 (2012)
In 2012, Vivian and Javier Moreno brought a lawsuit against the city of Riverside, alleging that the city had illegally moved money from its water utility fund to the general fund. This move was a violation of Proposition 218, which prevents California cities from using specific fees and charges (such as water utilities fees) for general government services without voter approval. In May 2013, the city settled the lawsuit by ending the transfers between funds and by agreeing to restore $10 million from the general fund back to the water utility fund.[2]
In order to reinstate these funds transfers while abiding by Proposition 218, the city sought voter approval through a 2013 ballot measure. The measure was passed by more than two-thirds of voters, allowing the city to resume moving money from the water utility fund to the general fund.
