Michigan: Gov. Rick Snyder appointed Circuit Judge David Viviano to the Michigan Supreme Court on February 27, 2013. Viviano has served on the 16th Circuit Court in Macomb County since 2007. He will fill the vacancy of retired Justice Diane Hathaway, who left the court following a real estate fraud scandal. Viviano will serve on the state's highest court until the 2014 election, at which time he must run for office if he wishes to fill the remaining two years of Hathaway's term.[1]
Following the appointment, Viviano stated,
“ | It is a tremendous responsibility and one that I cherish. I look forward to working with my esteemed Supreme Court colleagues to provide the thoughtful, impartial justice that citizens deserve.[2][3] | ” |
Regarding the new justice, Gov. Snyder stated,
“ | His deep respect for the judicial branch of government and his commitment to the rule of law will serve Michigan well. I have every confidence that he will be a compassionate, principled justice.[2][3] | ” |
Since Viviano is a Republican, his appointment gives that party a 5-2 majority over the Democrats on the state's Supreme Court. Though Michigan judicial elections are technically nonpartisan, political affiliations are evident.[1]
