On September 8, 2023, Philadelphia District Attorney Lawrence Krasner (D) charged former Philadelphia police officer Mark Dial with murder, voluntary manslaughter, and aggravated assault for the August 14, 2023, shooting of Eddie Irizarry during a traffic stop.[1] The Philadelphia Police Department originally reported that Irizarry was outside his vehicle and lunged at officers after they stopped him for driving recklessly and driving the wrong way down a one-way street. The department updated its account on August 16, 2023, after body camera footage showed Irizarry still inside the car.[2] The footage showed Dial exiting a police cruiser "before shouting at Irizarry to 'show your hands' and adding 'I will f-ing shoot you.' He then fired multiple shots at Irizarry as he sat in the driver's seat."[3]

Pew presided over Dial's preliminary hearing on September 26, 2023. Dial's attorneys argued that Irizarry had a knife that looked like a gun and that Dial feared for his life and acted in self-defense.[4] Pew dismissed all the charges against Dial, citing a lack of evidence.[3] That same day, the Philadelphia District Attorney's Office said the office "disagrees with the decision by Municipal Court Judge Wendy L. Pew to dismiss all criminal charges against defendant Mark Dial for the killing of Eddie Irizarry on August 14, 2023. Special Investigations Unit prosecutors will be filing an appeal of this decision to the Court of Common Pleas by the end of today. In keeping with our oath to seek justice, we will move to have all criminal charges, including Murder, reinstated against this defendant.”[5]
